FEDEX COMPETITION TERMS AND CONDITIONS

• 1) The Competition is carried out simultaneously in Germany, Austria, Hungary, Poland, the United Kingdom, France, the Netherlands, Belgium, Luxembourg, Spain, Ireland, Italy, Switzerland, Sweden, Denmark, Finland, Norway, Lithuania, Latvia, Estonia, India and the Czech Republic (“Countries”). Please refer to Article 19 for specific rules for Italy. Participation in the competition is open to businesses, companies and individuals acting in the framework of their professional activities except for employees of FedEx Corporation or any of its affiliates or advisers and their family members. No charge shall be borne by the participant to participate in this competition.
• 2) The competition is accessible on the FedEx website mysolution.fedex.com from 1 October 2009 until midnight (GMT) on 15 December 2009.
• 3) The Purpose of this competition is to promote FedEx’s products and services. The competition consists of answering five (5) questions and answering the tie-break speed question. For the first five (5) questions, four (4) possible answers are provided; only one is the correct answer. Each participant may enter the competition only one (1) time. Participants who are able to enter one or more FedEx Air Waybill numbers, corresponding to shipments sent by the participant between 1 October 2009 and 15 December 2009 will benefit from the removal of one wrong answer (among the multiple choices) per AWB provided. A participant may enter up to five (5) FedEx Air Waybill numbers. One AWB can only be used once for all questions. A valid FedEx Air Waybill number is an Air Waybill for a consignment that has been shipped with FedEx between 1 October and 15 December 2009.
• 4) Amongst the participants that entered correct answers to the six questions of the competition, the winners will be determined on the basis of their entry on the tie-break speed question. The winners will be ranked in function of the time spent to answer the tie-break question. In case of a tie, the winner will be decided through a draw by an impartial person. If less than 10 participants answer the six questions correctly, then the number of prizes will be limited to the number of participants that answered the six questions correctly. Each participant can only win one prize. All winners will be notified by email to the address supplied by the participant on the entry form within 28 days of the closing date. In the event a winner does not claim their prize within 30 calendar days from the date notification is sent by FedEx they will forfeit their right to claim the prize. Any forfeited prizes will not be reallocated by FedEx among participants.
• 5) Prizes will be delivered to winners at the address given by the participant on the entry form within 28 days of FedEx receiving notice from the participant claiming the prize. FedEx shall not be responsible for telephonic errors or mistaken addresses communicated by the winners.
• 6) The competition is to win – for the ten (10) winners: One eBook Cybook Opus Bookeen each with a commercial value of 204.99 Euros including VAT. Total value of all prizes is 2049.90 Euros. FedEx may substitute prizes at its own discretion. FedEx will not entertain any claim or correspondence with regard to the prize or otherwise, other than specified in Article 15 hereto. FedEx makes no warranty or representation either express or implied, with regard to the type, quality or fitness of the prize.
• 7) The prizes are non-transferable and no cash alternatives to the prizes are available.
• 8) FedEx takes no responsibility for participants’ entries that are lost, mislaid, incomplete or undelivered due to reasons outside its control.
• 9) A list of all winners will be available 28 days after the closing date by emailing contact@myshippingsolution.com using participant contact details as indicated upon registration.
• 10) There will be no correspondence of any manner about entries, the competition or its conduct, other than that specified in Article 15 hereto.
• 11) By entering the competition, participants agree to be bound by these terms and conditions. All decisions made by FedEx are final. FedEx may disqualify a participant from winning any prizes and participating in the competition if FedEx has reasonable grounds to suspect that this participant may be in breach any of the present terms and conditions.
• 12) FedEx reserves the right to add, modify, change, vary any or all of the terms of the competition and the same shall be binding on all parties at all times.
• 13) FedEx may choose to revoke the competition without any prior notice of any form at its sole discretion, without having any liability/consequences whatsoever towards any participant.
• 14) DATA PROTECTION: Information collected during the entry to the competition may be retained by FedEx and its group companies to properly process the application of the participants and for the performance of the competition. FedEx shall comply with all mandatory applicable laws and regulations concerning data protection and privacy. In limited circumstances FedEx may be required by law to disclose the participant’s personal data.
• 15) Any complaints regarding the competition can be addressed to FedEx at Federal Express International SNC, 125 avenue Louis Roche, 92238 Gennevilliers cedex, France. Complaints shall be answered within a reasonable period of time.
• 16) FedEx expressly waives the right of recovery from winners of any tax related to the prizes.
• 17) The terms and conditions are deposited with Maître Jean-Louis Hauguel, Huissier de Justice - 14, rue du Faubourg Saint Honoré - 75008 Paris and are published on mysolution.fedex.com.This competition is being organized in compliance with the laws of the Countries, including the Dutch Code of Conduct on Promotional Games of Chance (Gedragscode Promotionele Kansspelen).
• 18) Except for Italy, this competition is being run by: Federal Express International SNC, 125 avenue Louis Roche, 92238 Gennevilliers cedex, France and is subject to the laws of France.

• 19) ITALY: A separate competition is carried out for participants resident in the Republic of Italy, the Republic of San Marino and the Vatican (“Italy”). This competition is carried out on the entire territory of Italy and is subject to the forgoing terms and conditions except as specified hereafter:
• 19.1) The competition is being run by: Federal Express Europe, Inc. – Filiale Italiana – Centro Direzionale Milano Oltre – via Cassanese, 224 Palazzo Tintoretto – 20090 Segrate (MI) – Italy.
• 19.2) Five (5) prizes are reserved for the winners of the competition carried out in Italy. The overall value of the prizes awarded in the competition carried out in Italy amounts to 1.024,95 Euros. The winners will be the five (5) Italian residents participants that have answered all six (6) questions correctly. In the event of tied winners, a subsidiary open question will be used to determine the winner. To determine the winner, the classification will consider the closest one (1) answer to the correct one. In case there is a situation of total parity between two or more participants after the tie-breaker, FedEx will proceed with a prize draw to determine the winner. The competition is to win: For the five (5) winners: One eBook Cybook Opus Bookeen each with a commercial value of 204.99 Euros including VAT.
• 19.3) FedEx may substitute prizes only if it is impossible to deliver the announced prizes for reasons out of control of FedEx. In such case, FedEx will duly inform participants and winners, and replacement prizes shall be to the best extent possible similar to those originally announced.
• 19.4) In the event a winner does not claim their prize within 30 calendar days from the date notification is sent by FedEx they will forfeit their right to claim the prize and such prize shall be delivered to Medici Senza Frontiere - Via Volturno 58, 00185, Roma.
• 19.5) Articles 15 and 16 do not apply to the game carried out in Italy.
• 19.6) The terms and conditions of the game carried out in Italy are deposited with the Ministry of Economy pursuant to art. 11 of D.P.R. no. 430 of 26 October 2001 and are published on mysolution.fedex.com.
• 19.7) All activities of the competition carried out in Italy, except the packaging of prizes are carried out on the Italian territory.
• 19.8) Article 19 will prevail in the event of any inconsistency between Article 19 and other provisions of the terms and conditions.
